Colored Pencil = Gel Layer Problem??

I noticed that once I upgaded to 9.5 , when ever I open a new layer and use a colored pencil brush on it it will automatically change to a gel layer. I then have to change it back to normal and all is fine.

This only occurs with a new empty layer. Anyone else having this color Pencil/gel layer problem, that knows a fix?
